shoplifting at urban outfitters, what will happen?
I got caught at urban outfitters shoplifting a book, wallet and 2 shoes. took me to the back and asked me some questions and wrote some information down plus something that said i shoplifted from there and that i would be ban for 3 years. i took my friends bag by mistake and made me accept that it was in my possession and that i would receive the consequences. i didn't sign any papers and the police wasn't involved. this is my second time being caught which was once from frys electronic which i had to go to court for. so i wanted to know what would happen. i know i will get a fine but i was wondering what are the chances of having to go to court or not.
I am an attorney and I know a lot about this subject. Do not take this as creating an attorney-client relationship. You may, however, find it helpful.
From your post, it sounds like you are not being charged criminally. If so, you are very lucky, particularly being a second offender.
If you are charged criminally, what you absolutely must do is consult an attorney. Do not expect judges, prosecutors, or other court staff to give you good advice. It is not their job to protect your interests. Some of them perceive an unrepresented person as an opportunity to quickly process a case. That usually means that the consequences for you would be worse than if you are represented by a lawyer.
Again, if there is a criminal case, if you do not have an attorney on board by the time of the court appearance, tell the judge that you want to talk to an attorney. If you do not have the money to pay for an attorney, ask the judge to appoint one for you. Probably, the judge will then set the matter over for another day and not require you to enter a plea. If you must enter a plea at that time, then just plead “not guilty”. Make sure that you do not make any statements to the judge, prosecutor, or anyone else, in or out of court, about what happened, other than the fact that you have been charged with shoplifting.
Repeat offenders eventually go to jail, not always on the second offense, but eventually, and sometimes for a long time.
Although the criminal proceedings are the worst part, unfortunately you will probably have to deal with something called a “civil demand”. In most states, if you are caught shoplifting, even if not convicted, the store can sue you for damages and a penalty. Usually, this is many times the value of the goods you tried to steal. If you do receive a civil demand and you do not pay voluntarily, it may be possible for the store to add attorney fees to the debt if it sues you, which could run into the thousands of dollars.
You have probably already been given an order banning you from the store. If not, you can expect to receive one in the mail. Take that seriously, If you go into the store again or even onto the parking lot, you can be arrested for criminal trespass.
Your name may be entered into a national retail theft database, whether or not you are ever convicted. This database is not open to the public, but it is open to any member retail company. The retailers check this when anyone applies for a job and if your name shows up on it you are usually not hired. So, do not ever expect to work in retail, at least for seven years. I understand that, if entered, your name will remain in the database for that long..

Boyfriend's 20th Birthday? I've bought everything!?
I've been with him for almost two years, he is my best friend and we are very close but the problem is I've given him everything I can think of. From sentimental and homemade gifts (poems, paper mache heart, custom jigsaw puzzle, hand crafted picture frame, a few different photos of us, paintings, birthday cake backed and decorated by me) as well as materialistic gifts (deck for his car, ipod, hat and scarf, expensive wallet, designer shirts).
To make matters worse, he has like every electronic and article of clothing he wants right now... Subs for his car, lots of clothes, laptop, brand new camera, etc etc etc
I'm going to make him a nice card or poem like I usually do as well as probably a cake... but what I'm stuck on is I want to buy him something too. My max budget is $200 but I'd rather keep it around the $100 mark or less as we just celebrated christmas...

hmm you could make him a special dinner and make it super romantic and buy him like maybe a nice weather wallet personalized with like your initials in it or something so whenever he pulls out his wallet he is reminded to buy you stuff
